Whereas on the 22nd day of September,
A.D. 1862, a proclamation was
issued by the President of the United States, containing, among other things,
the following, to wit:
"That on the 1st day of January,
A.D. 1863, all persons held as
slaves within any State or
designated part of a State
the people whereof shall then
be in rebellion against the
United States shall be then,
thenceforward, and forever free
and the executive government of
the United States, including
the military and naval authority
thereof, will recognize and maintain
the freedom of such persons and will
do no act or acts to repress such
persons, or any of them, in any efforts
they may make for their actual freedom.
"That the executive will on the 1st
day of January aforesaid, by
proclamation, designate the
States and parts of States, if any,
in which the people thereof,
respectively, shall then be in
rebellion against the United
States and the fact that any
State or the people thereof shall
on that day be in good faith
represented in the Congress of
the United States by members
chosen thereto at elections
wherein a majority of the qualified
voters of such States shall have
participated shall, in the absence
of strong countervailing testimony,
be deemed conclusive evidence that
such State and the people thereof
are not then in rebellion against
the United States."
Now, therefore, I, Abraham Lincoln,
President of the United States, by
virtue of the power in me vested as
Commander-In-Chief of the Army and
Navy of the United States in time of
actual armed rebellion against the
authority and government of the
United States, and as a fit and
necessary war measure for supressing
said rebellion, do, on this 1st day
of January, A.D. 1863, and in accordance
with my purpose so to do, publicly
proclaimed for the full period of
one hundred days from the first
day above mentioned, order and
designate as the States and parts
of States wherein the people thereof, respectively, are this day in
rebellion against the United
States the following, to wit:
Arkansas, Texas, Louisiana
(except the parishes of St.
Bernard, Palquemines, Jefferson,
St. John, St. Charles, St.
James, Ascension, Assumption,
Terrebone, Lafourche, St. Mary,
St. Martin, and Orleans,
including the city of New Orleans),
Mississippi, Alabama, Florida,
Georgia, South Carolina, North
Carolina, and Virginia (except
the forty-eight counties designated
as West Virginia, and also the
counties of Berkeley, Accomac,
Morthhampton, Elizabeth City,
York, Princess Anne, and Norfolk,
including the cities of Norfolk
and Portsmouth), and which excepted
parts are for the present left
precisely as if this proclamation
were not issued.
And by virtue of the power and
for the purpose aforesaid, I do
order and declare that all persons
held as slaves within said
designated States and parts of
States are, and henceforward shall
be, free and that the Executive
Government of the United States,
including the military and naval
authorities thereof, will recognize
and maintain the freedom of said
persons.
And I hereby enjoin upon the people
so declared to be free to abstain
from all violence, unless in
necessary self-defence and I
recommend to them that, in all
case when allowed, they labor
faithfully for reasonable wages.
And I further declare and make
known that such persons of suitable
condition will be received into
the armed service of the United
States to garrison forts, positions,
stations, and other places, and to
man vessels of all sorts in said
service.
And upon this act, sincerely believed
to be an act of justice, warranted
by the Constitution upon military
necessity, I invoke the considerate
judgment of mankind and the gracious
favor of Almighty God.
1862년 9월 22일을 기하여 미합중국 대통령 링컨은 다음과 같은 내용의 선언문을 발표하였다.
현재 미합중국에 대하여 반란 상태에 있는 주 또는 주의 일부의 예속 상태인 노예들은 1863년 1월 1일 이후부터 영원히 자유의 몸이 될 것이다. 육군 및 해군을 포함하여 미국의 행정부는 그들의 자유를 인지하고 지켜줄 것이고, 그들을 다시 억압하지 않을 것이며, 또한 그들이 진정한 자유를 얻고자 노력하는 데 어떠한 제약도 가하지 않을 것이다.
미국 행정부는 앞서 말한 1월 1일에 여전히 미합중국에 대하여 반란 상태에 있는 주들과 주의 일부 지역을 선포에 의해 (반란주로) 지정할 것이다. 그리고 그날까지 주 또는 주민 유권자의 과반수 이상이 투표하여 선출한 대의원들을 성의를 가지고 미국 의회에 파견하고 있다면 이를 뒤엎을 만한 다른 증언이 없는 한, 그 주와 주민은 미국에 대하여 반란상태에 있지 않은 것으로 간주할 것이다.
그러므로 미국의 대통령인 나, 에이브러햄 링컨은 미국 정부의 권위에 대한 실제 무장 반란시에 미국 육해군 총사령관으로서 부여된 권한에 의거하여, 그리고 이 반란을 진압하기 위한 적합하고 필요한 조치로서, 1863년 1월 1일부터 그 이후 100일 동안, 미국에 대항해 반란 상태에 있는 다음과 같은 주와 주의 일부 지역을 반란주로 지명하는 바이다.
아칸사스, 텍사스, 루이지애나(세인트 버나드, Palquemines, 제퍼슨, 세인트 존, 세인트 찰스, 세인트 제임스, Ascension, Assumption, 테레본, Lafourche, 세인트 매리, 세인트 마틴, 그리고 올리언즈 지역은 제외하고 뉴올리언즈는 포함함), 미시시피, 알라바마, 플로리다, 조지아, 사우스 캐롤라이나, 노우스 캐롤라이나, 그리고 버지니아(웨스트 버지니아로 지정된 45개 카운티와 버클리, 마코맥, 엘리자베스 시티, 요크, Princess Anne, 그리고 노퍽을 제외하고 노퍽 및 포츠머스의 도시들은 포함함), 그리고 제외된 지역은 현재 노예해방선언이 발표되지 않은 것으로 간주되어 있는 상태이다.
상기 권한과 언급한 목적을 위하여, 나는 이상의 반란주로 지정된 주와 주의 일부 지역에서 노예로 있는 모든 사람은 이제부터 자유의 몸이 될 것임을 선포한다. 그리고 육군과 해군 당국을 포함하여 미국의 행정부는 앞서 언급한 자들의 자유를 인정하고 유지할 것이다. 나는 자유가 선언된 상기의 노예들에게 자기 방어를 위해 필요한 경우가 아니라면 모든 폭력 행위를 삼갈 것을 명한다. 그리고 그들에게 허용된 모든 경우에 적합한 임금을 벌기 위하여 충실히 노동할 것을 권유하는 바이다. 그리고 본인은 적합한 조건을 갖춘 자는 미국 군대에 입대하여 요새, 진지 및 기타부서에 배치되고, 모든 종류의 선박에도 배치될 것임을 알리는 바이다. 그리고 진실로 정의를 위한 행위이며 군사상의 필요에 의하여 헌법에 의해 보증된 이 선언에 대하여 전능하신 하나님의 은총과 인류의 신중한 판단이 함께 하기를 기원한다.
